General terms and conditions
GENERAL INFORMATION
These general terms and conditions of sale (hereinafter referred to as GTC) apply to any purchase of products or services made by a customer on the Glowing Skin website, www.glowingskin.ch (hereinafter referred to as the Site).
The seller of products or services may be either Glowing Skin (hereinafter Glowing Skin) or a third-party company (hereinafter the "Partner") via the Marketplace GS (hereinafter "GS Marketplace"). For products or services offered within the GS Marketplace, the offeror is the Partner identified by the phrase "sold and shipped by". This phrase appears on the product details page, in the shopping cart during checkout, at checkout, and on the invoice.
The masculine form "client" used below naturally refers to both female and male customers. Specific conditions for the purchase of certain products or services are defined below. Online product and service offers are valid only while they are visible on the Site and while stocks last. Images on the Site are for illustrative purposes only and do not form part of the contractual terms. Information contained in catalogs and explanatory notes is provided for informational purposes only and does not constitute contractual documents.
Glowing Skin accepts no responsibility for any errors or omissions related to drawings, images or diagrams, or appearing on catalogues or notices.
Glowing Skin reserves the right to modify these Terms and Conditions at any time. The version of the Terms and Conditions in effect at the time of the order is binding and cannot be unilaterally modified for that order. The Terms and Conditions are available in French.
All products and services offered on the Site are exclusively for customers who have their domicile/registered office in Switzerland.
When the customer clicks on the Partner's name, the customer accesses the Partner's contact details as well as the specific terms and conditions of sale concerning their merchandise.
Certain conditions may be specific to the Partners and may differ from those offered by Glowing Skin. Products purchased from a Partner Marketplace are neither returnable nor exchangeable by Glowing Skin.
Glowing Skin and/or its Partners reserve the right to refuse orders exceeding the usual quantities for a household.
PRICE
The prices displayed on the Site are expressed exclusively in Swiss francs. They include all taxes (VAT). However, they do not include processing and shipping fees, which will be charged separately. All orders are payable exclusively in Swiss francs. Glowing Skin and its Partners reserve the right to change their prices at any time, but the prices charged to the customer for delivered products are those in effect on the date of the order and shown on the order confirmation.
Furthermore, promotional discounts offered as part of sales campaigns on the Site can, unless otherwise stated, be combined with other discounts. These special promotional discounts are deducted directly from the order total.
PROMOTIONAL CODES AND HOW TO USE THEM
A promotional code is a voucher issued by Glowing Skin or a Partner that cannot be bought or sold. They are issued by Glowing Skin or a Partner as part of promotional campaigns and are valid for a limited time.
A promotional code is always associated with a promotional period and can only be used during that period. Certain items may be excluded from the promotion at the discretion of Glowing Skin or the Partner. Gift cards cannot be purchased using promotional vouchers. A promotional code may also be subject to a minimum purchase amount.
The value of the merchandise must be at least equal to the value of the promotional code. If the value of the merchandise exceeds this, the customer may pay the difference using one of the payment methods offered on the Website. Exchanging a promotional code for cash is strictly prohibited. No refund of a promotional code will be granted if the merchandise is returned in whole or in part.
The promotional code must be used before completing the order. No subsequent application is permitted. The promotional code is non-transferable.
When a promotional code has been used during a purchase, Glowing Skin reserves the right to charge the customer the original price of the merchandise which is kept by the customer if – due to the cancellation of the order by the customer – the total value of the order is less than the amount of the promotional code.
CONTRACT CONCLUSION
The products and prices published in the online shop constitute an offer. However, this offer is always subject to the condition that delivery is possible or that the price indicated (by the manufacturer, by Glowing Skin or by the Partner) is free from error.
The contract is concluded as soon as the customer places their order with Glowing Skin. Order receipt is confirmed to the customer by an automatically generated email sent to the address they provided. This automatically generated order confirmation email does not constitute a guarantee of availability or delivery. It merely informs the customer that Glowing Skin or the Partner has received their order and that the contract is concluded, subject to the price indicated being correct for the items ordered and delivery being possible.
For orders concerning products offered by a Partner, the contract is concluded directly between the Partner and the customer at the time of the order on the Site, by telephone, or by email. Glowing Skin acts solely as an intermediary through the GS Marketplace. In this case, Glowing Skin limits its role to that of intermediary and service provider for the Partner, and does not itself become a contracting party to the transaction between the customer and the Partner.
ORDER
An order only becomes final after acceptance by Glowing Skin or the Partner. Submitting an order implies the customer's full acceptance of these Terms and Conditions, to the exclusion of all other terms or conditions. The terms and conditions governing sales in Glowing Skin stores do not apply to orders placed on the Website. Glowing Skin and/or the Partner reserve the right to refuse a customer's order without providing a reason.
DELIVERY AND IN-STORE PICKUP
Regarding Glowing Skin products and services, all delivery and collection options mentioned on the Site under "Delivery" are available to the customer.
For products purchased by the customer from a Partner, in-store pickup is not available. Delivery of purchased products will be made exclusively by mail, according to the delivery methods offered by each Partner and detailed on their Partner page.
The customer must provide a delivery address in Switzerland.
If the customer fails to receive the ordered goods on the agreed or indicated delivery date, Glowing Skin or the Partner may terminate the contract (cancellation) and reserves the right to charge the customer for the delivery costs incurred and/or any loss in value.
SPECIFIC CONDITIONS FOR CERTAIN SERVICES ON THE SITE
Collection of Click & Collect and Click & Collect Express orders
The provision of bags (paper and plastic) will be subject to a charge, including when collecting Click & Collect orders. This decision is primarily motivated by sustainability concerns, but also by new legislation prohibiting the free distribution of plastic bags in the non-food sector. If you do not wish to take your order in its packaging, we encourage you to bring an alternative transport solution.
When a customer does not collect the ordered products (collection from a store) within 14 working days following the agreed date, Glowing Skin reserves the right to terminate the contract (cancellation).
Only products offered by Glowing Skin are eligible for Click & Collect order pickup.
Glowing Skin Gift Card
The Glowing Skin gift card is valid in all Glowing Skin department stores and on the website. Each department store cashier is authorized to provide the balance upon request and can reload the card if desired. The remaining amount is carried over; it cannot be converted into cash, exchanged for a voucher, or credited to a credit card. The card will not be replaced if lost or stolen. Glowing Skin gift cards are for personal use only. Selling or using them in any other way for profit is strictly prohibited.
No points are awarded for the purchase of gift cards. Points are awarded when a Glowing Skin gift card is redeemed and a Glowing Skin customer card is presented.
When placing an online order on the Site, this gift card is exclusively reserved for Glowing Skin products. No purchases for a Partner offer on the GS Marketplace can be made using the Glowing Skin gift card.
Glowing Skin Digital Gift Card
The Glowing Skin digital gift card is valid in all stores and on the website up to the amount available on the card at the time of purchase. The card balance can be checked and topped up at any checkout. The remaining balance can be used later and cannot be exchanged for cash, vouchers, or credited to a credit card. Glowing Skin accepts no liability and will not replace the card in case of loss, theft, unauthorized copying, or use by an unauthorized person. Glowing Skin also reserves the right, in case of suspected fraud or forgery, to refuse the card as a means of payment and to take legal action. Glowing Skin gift cards are intended exclusively for personal use, and the sale or any other commercial use of these cards is strictly prohibited.
When placing an online order on the Site, this gift card is exclusively reserved for Glowing Skin products. No purchases for a Partner offer on the GS Marketplace can be made using the Glowing Skin gift card.
PAYMENT
The price charged is the price indicated on the order confirmation sent to the customer. With the exception of offers from Partners on the GS Marketplace and unless otherwise specified, all products and services* are payable using the following credit cards: EuroCard/MasterCard, Visa, American Express, Diners.
Regarding GS Marketplace offers, the payment method is restricted to payment by credit card (Visa and MasterCard).
All payment transactions are processed securely, using the highest security standard (https://). The data recorded by Glowing Skin constitutes proof of all transactions between Glowing Skin and its customers. The data recorded by the payment system constitutes proof of financial transactions. The credit card used for payment is only charged when the order is placed.
RETENTION OF TITLE
When products or services are ordered, they remain the property of Glowing Skin or the Partner until full payment is received. Glowing Skin or the Partner reserves the right to record this retention of title in the register. Before the transfer of ownership takes place, no pledge, assignment as security, transformation, or modification is permitted without the express consent of Glowing Skin or the Partner.
EXCHANGES, RETURNS, WARRANTY CLAIMS AND COMPLAINTS
The customer will send claims for defective goods and/or services and returns directly to Glowing Skin or the Partner, according to each party's terms and conditions. The customer will arrange the details of the procedure with Glowing Skin or the Partner. The existence of any disputes does not release the customer from their obligation to pay the full invoice amount or the total value of the disputed amount.
It is the customer's responsibility to inspect the goods immediately upon delivery and to note any defects or non-conformities. Generally, Glowing Skin accepts returns provided they are unused, clean, and undamaged, or in their original (undamaged) packaging. In the case of a return, shipping costs are covered by Glowing Skin.
Return conditions
Products purchased from Glowing Skin can be returned to any Glowing Skin store within 30 days of receipt, upon presentation of proof of purchase, provided they are unused, clean, undamaged, and in their original packaging. Items damaged or soiled by the customer are generally not accepted for return.
Returns of products purchased on the Site and offered for sale by a Partner through the GS Marketplace must be made according to the conditions established by the Partner. Glowing Skin will refuse any return of these products if they are dropped off at its department stores or returned to its Customer Service department.
It is the customer's responsibility to inspect the goods upon receipt and to report any defects or discrepancies compared to their order. The legal provisions governing complaints (Art. 201 CO) apply.
Return conditions for Glowing Skin products
Returns are accepted within 30 calendar days of receipt or collection from the store. If the customer cannot provide proof of receipt, the 30-day period begins from the date the order was shipped.
In all cases, only items in their original packaging, unused, clean, complete and undamaged, accompanied by the label or proof of purchase, will be accepted.
In the event of a return, the customer is responsible for shipping costs and also bears the risk of loss or damage during transit. Merchandise can be returned via the postal service or free of charge to a department store.
To return a product by mail, you will find a return slip in the package. The merchandise must be returned to the following address:

Partner Products from the Marketplace should not be returned to the above address but directly to the partner whose address is stated on the delivery note received.
For free returns to the department store, the merchandise must be brought to Customer Service, along with the delivery note or order confirmation. Refunds can only be issued via the original payment method. Therefore, no cash refunds are given on-site. If the payment method selected when placing the order is no longer available (whether Twint, credit card, or other), the customer will receive the refund amount as a gift card.
Upon receipt of the merchandise, Glowing Skin verifies that it is in good condition and, if so, decides on a refund. As soon as the distribution center has received and inspected your return, the refund will be credited to the same payment method used for your order.
I paid with a gift card and my credit card. How will I be reimbursed? If you paid using a combination of gift card and credit card, the portion paid with the gift card will be refunded to the gift card upon return. The remaining amount will be credited to your credit card.
TERMINATION CLAUSE
Any total or partial failure by the customer to fulfill any of its obligations, as well as any failure to meet any payment deadline, may result, at the discretion of Glowing Skin or the Partner, in either the immediate demand for payment of all sums still due for any reason whatsoever, and the suspension of all deliveries, or the termination of current contracts.
APPLICABLE LAW / DISPUTES
These Terms and Conditions are governed by Swiss law. Any dispute relating to these Terms and Conditions shall be subject to the exclusive jurisdiction of the ordinary courts of Geneva, Switzerland.

GENERAL TERMS AND CONDITIONS OF USE OF CUSTOMER RATING FUNCTIONS
These Terms of Use govern the conduct of the customer in connection with the customer review service.
By submitting your reviews or any other message via the Site, you guarantee:
- that you are the sole author and owner of the intellectual property rights to the content;
- that you have voluntarily waived all "moral rights" you may have over said content;
- that all the content you publish is accurate;
- that the use of the content you provide does not violate these terms of use and does not harm any person or entity.
- that you assume full responsibility for the content of your contribution, releasing Glowing Skin and/or its Partners from all liability
- Furthermore, you agree not to send any content:
- that you know to be false, inaccurate or fallacious;
- that infringes any copyright, patent, trademark, trade secret or other proprietary rights, publicity rights or privacy rights of any third party;
- that violates any law or ordinance, or any decree or regulation (including, but not limited to, those governing consumer protection, unfair competition, discrimination or false advertising);
- which is or may reasonably be considered to be defamatory, inciting hatred or racially or religiously insulting, unlawfully threatening or constituting unlawful harassment against any individual or business;
- for which you have been paid or received compensation from any unapproved third party;
- which includes information referring to other websites, addresses, email addresses, contact details or telephone numbers;
- which contains viruses or other potentially harmful computer programs or files.
You agree to indemnify and hold harmless Glowing Skin and the Partners (and their officers, directors, agents, subsidiaries, joint ventures, employees and third-party service providers) from and against any and all claims, demands and damages (direct and indirect) of any kind and nature, including reasonable attorneys' fees, that Glowing Skin and/or the Partners may suffer as a result of a breach of your above commitments and warranties, or your violation of any law or the rights of a third party.
All content you submit may be used at Glowing Skin's sole discretion. Glowing Skin reserves the right to edit, condense, refuse to publish, remove, or delete any content on the Glowing Skin website that Glowing Skin deems, in its sole discretion, to violate the Content Guidelines or any other provision of these Terms of Use. Glowing Skin does not guarantee the right to edit or delete any content you submit. Written ratings and comments are generally published within two to four business days, subject to the above. No part of the content you submit will be subject to any obligation of confidentiality on the part of Glowing Skin or its Partners.
