General Terms and Conditions
GENERAL PROVISIONS
These General Terms and Conditions of Sale (hereinafter GTC) apply to any purchase of products or services made by a customer on the Glowing Skin website, www.glowingskin.ch (hereinafter the Site).
The seller of products or services may be either Glowing Skin (hereinafter Glowing Skin) or a third-party company (hereinafter the "Partner") through the GS Marketplace (hereinafter "GS Marketplace"). For products or services presented within the framework of the GS Marketplace, the offeror is the Partner identified by the words "sold and shipped by". This mention appears on the product detail page, in the shopping cart when ordering, during payment, and on the invoice.
The masculine form "customer" used below naturally refers to both female and male customers. The specific conditions for the purchase of certain products or services are defined below. Online product and service offers are valid only as long as they are visible on the Site and within the limits of available stock. Images on the Site are for illustration purposes only and are not part of the contractual conditions. Information appearing in catalogs and explanatory notices is given for informational purposes only and does not constitute contractual documents.
Glowing Skin disclaims all responsibility for any errors or omissions related to drawings, images, or diagrams, or appearing in catalogs or notices.
Glowing Skin reserves the right to modify the GTC at any time. The version of the GTC in force at the time of the order is decisive and cannot be unilaterally modified for that order. The GTC are available in French.
All products and services offered on the Site are exclusively intended for customers whose domicile/registered office is in Switzerland.
When the customer clicks on the Partner's name, the customer accesses the Partner's contact details and the specific sales conditions concerning their merchandise.
Certain conditions may be specific to Partners and may differ from the conditions offered by Glowing Skin. Products purchased from a Marketplace Partner cannot be returned or exchanged by Glowing Skin.
Glowing Skin and/or the Partners reserve the right to refuse orders exceeding usual quantities for a household.
PRICES
Prices indicated on the Site are exclusively in Swiss Francs. They are inclusive of all taxes (VAT). However, they do not include participation in processing and shipping costs, which will be invoiced separately. All orders are payable exclusively in Swiss Francs. Glowing Skin and the Partners reserve the right to modify their prices at any time, but the prices invoiced to the customer for the products delivered are those in effect on the order date and appearing on the order confirmation.
Furthermore, promotional discounts offered as part of commercial promotions on the Site are, unless otherwise stated, cumulative with other reductions. These special promotional discounts are deducted directly from the order amount.
PROMOTIONAL CODES AND THEIR USE
A promotional code is a voucher issued by Glowing Skin or a Partner that cannot be bought or sold. They are issued by Glowing Skin or a Partner as part of promotional campaigns for a limited period of validity.
A promotional code is systematically associated with a promotional period and can only be used during this defined period. Certain items may be excluded from the promotion at the discretion of Glowing Skin or the Partner. A gift card cannot be purchased with promotional vouchers. A promotional code may also depend on a minimum purchase amount.
The merchandise amount must at least be equal to the promotional code amount. If the merchandise amount is higher, the customer can make up the difference using one of the payment methods offered on the Site. The exchange of a promotional code for a cash payment is strictly prohibited. No request for a refund of a promotional code will be granted if the merchandise is totally or partially returned.
The promotional code must be used before the order is concluded. No subsequent imputation is authorized. The promotional code cannot be transferred to third parties.
If a promotional code has been used during a purchase, Glowing Skin reserves the right to charge the customer the original price of the merchandise retained by the customer if – due to the cancellation of the order by the latter – the total value of the order is less than the promotional code amount.
CONCLUSION OF THE CONTRACT
The products and prices published in the online store constitute an offer. This offer is, however, always subject to the condition precedent that delivery is possible or that the indicated price (by the manufacturer, by Glowing Skin, or by the Partner) is free of error.
The contract is concluded as soon as the customer places their order with Glowing Skin. Receipt of the order is confirmed to the customer by an automatically generated email sent to the address provided by the customer. The automatically generated order confirmation email does not constitute a guarantee of availability or delivery. It only indicates to the customer that Glowing Skin or the Partner has received their order and that the contract is concluded, provided that the indicated price matches the price of the ordered items and that delivery is possible.
For orders concerning products offered by a Partner, the contract is concluded directly between the Partner and the customer at the time of order on the Site, by telephone contact, or by email. Glowing Skin acts only as an intermediary through the GS Marketplace. Glowing Skin limits its involvement in this case to the role of intermediary and service provider for the Partner but does not itself become a contracting party to the transaction between the customer and the Partner.
ORDER
An order becomes final only after its acceptance by Glowing Skin or the Partner. The submission of an order by the customer implies full acceptance of these GTC, to the exclusion of all other terms or conditions. The conditions governing sales in Glowing Skin stores are not applicable to orders placed on the Site. Glowing Skin and/or the Partner reserve the right to refuse a customer's order without justification.
DELIVERY AND IN-STORE PICK-UP
Concerning Glowing Skin products and services, all delivery and pick-up options mentioned on the Site under "Delivery" are available to the customer.
Concerning products purchased by the customer from a Partner, no in-store pick-up will be possible. Purchased products will only be delivered by postal shipment, according to the delivery terms proposed by each Partner and detailed on their Partner page.
The customer must provide a delivery address in Switzerland.
If the customer fails to collect the ordered merchandise on the agreed or indicated delivery date, Glowing Skin or the Partner may terminate the contract (cancellation) and reserves the right to charge the customer for incurred delivery costs and/or any loss of value.
SPECIFIC CONDITIONS FOR CERTAIN SERVICES ON THE SITE
Collection of Click & Collect and Click & Collect Express orders
Bags (paper and plastic) will be charged for, including when collecting Click & Collect orders. This decision is mainly motivated by sustainability reasons, but also by new legislation prohibiting the free provision of plastic bags in the non-food sector. If you do not wish to take your order in its packaging, we invite you to bring an alternative transport solution with you.
If a customer does not collect ordered products (pick-up from a store) within 14 working days following the agreed date, Glowing Skin reserves the right to terminate the contract (cancellation).
Only products offered by Glowing Skin are eligible for Click & Collect order pick-up.
Glowing Skin Gift Card
The Glowing Skin gift card is valid in all Glowing Skin department stores and on the Site. Each department store checkout is authorized to communicate the balance upon request and can recharge the card, if desired. The remaining amount is carried over; it cannot be converted into cash, exchanged for a voucher, or credited to a credit card. The card will not be replaced in case of loss or theft. Glowing Skin gift cards are exclusively for personal use. It is strictly forbidden to sell them or use them in any other way for profit.
No points are credited when purchasing gift cards. Points are credited when a Glowing Skin gift card is used and upon presentation of the Glowing Skin customer card.
When placing an online order on the Site, this gift card is exclusively reserved for Glowing Skin products. No purchase for a Partner offer on the GS Marketplace can be made using the Glowing Skin gift card.
Use of vouchers and gift cards
For clarification purposes, Glowing Skin vouchers and gift cards constitute a means of payment and can be used, up to their available balance, for the purchase of products or care services offered by Glowing Skin, subject to applicable validity conditions. However, they do not guarantee the permanent availability of a specific product, brand, care, or service. In the event that a product, brand, care, or service is no longer offered by Glowing Skin at the time of using the voucher or gift card, the customer must use the available balance on the Glowing Skin offer then available, without being able to demand the maintenance, identical replacement, or cash refund of the initially envisaged product or service.
Glowing Skin Digital Gift Card
The Glowing Skin digital gift card is valid in all stores and on the Site up to the amount available on the card at the time of purchase. The card balance can be checked and recharged at all checkouts. The remaining balance can be used later and cannot be exchanged for cash, vouchers, or credited to a credit card. Glowing Skin declines all responsibility and will not replace the card in case of loss, theft, illegal copying, or use by an unauthorized person. Glowing Skin also reserves the right, in case of suspected fraud or counterfeiting, to refuse the card as a means of payment and to take legal action. Glowing Skin gift cards are exclusively for personal use, and the sale or any other lucrative use of these cards is strictly prohibited.
When placing an online order on the Site, this gift card is exclusively reserved for Glowing Skin products. No purchase for a Partner offer on the GS Marketplace can be made using the Glowing Skin gift card.
Use of vouchers and gift cards

PAYMENT
The invoiced price is the price indicated on the order confirmation sent to the customer. With the exception of Partner offers on the GS Marketplace and unless otherwise specified, all products and services* are payable by means of the following credit cards: EuroCard/MasterCard, Visa, American Express, Diners.
Concerning GS Marketplace offers, the payment method is restricted to credit card payment (Visa and MasterCard).
All payment transactions are carried out in a secure zone, applying the highest security standard (https://). Data recorded by Glowing Skin constitutes proof of all transactions carried out between Glowing Skin and its customers. Data recorded by the payment system constitutes proof of financial transactions. The credit card used for payment is only debited when the order is placed.
RETENTION OF TITLE
When products or services are ordered, they remain the property of Glowing Skin or the Partner until full payment. Glowing Skin or the Partner reserves the right to make a corresponding entry in the register of retention of title. Before the transfer of ownership is effected, no pledging, assignment as security, transformation, or modification is permitted without the express consent of Glowing Skin or the Partner.
EXCHANGES, RETURNS, WARRANTY CASES, AND COMPLAINTS
The customer will send complaints for defective goods and/or services and returns directly to Glowing Skin or the Partner, according to their respective conditions. The customer will settle the details of the procedure with Glowing Skin or the Partner. The existence of any disputes does not release the customer from their obligation to pay the entire invoice or the total value of the dispute.
It is the customer's responsibility to check the merchandise immediately upon delivery and to make any reservations and complaints regarding any defects or non-conformities. Generally, Glowing Skin accepts returns of products provided they are unused, clean, and undamaged, or in their original (undamaged) packaging. In the case of a return of goods, shipping costs are borne by Glowing Skin.
Return Conditions
Products purchased from Glowing Skin can be returned to all Glowing Skin stores upon presentation of proof of purchase within 30 days of receipt, provided they are unused, clean, and undamaged, or in their original packaging. Items damaged or soiled by the customer are generally not accepted for return.
The return of products purchased on the Site and offered for sale by a Partner, within the framework of the GS Marketplace, must be made according to the conditions established by the Partner. Glowing Skin will refuse any return of these products if they are deposited at its department stores or returned to its Customer Service.
It is the customer's responsibility to check the merchandise upon receipt and to communicate any defects or discrepancies from their order. The legal provisions governing complaints (Art. 201 CO) apply.
Return Conditions for Glowing Skin products
Returns are possible within 30 calendar days following receipt or pick-up at a department store. If the customer is unable to present a confirmation of receipt, the 30-day period is counted from the order dispatch date.
In all cases, only items in their original, unused, clean, complete, and undamaged packaging, accompanied by the label or proof of purchase, will be accepted for return.
In the case of a return of merchandise, shipping costs are borne by the customer, who also bears the risk of shipment. Merchandise can be returned by post or returned free of charge to a department store.

Marketplace Partner Products must be returned directly to the partner whose address is stipulated on the received delivery note.
For a free return of merchandise to a department store, the merchandise must be brought to the Customer Service desk, accompanied by the delivery note or order confirmation. Refunds can only be made using the same payment method as the original payment. Therefore, no cash refunds will be issued on site. If the payment method selected when placing an order is no longer available (whether Twint, credit card, or otherwise), the customer will receive the return amount in the form of a gift card.
Upon receipt of the merchandise, Glowing Skin verifies that it is in good condition and, if applicable, decides on a refund. As soon as the distribution center has received and checked your return, the refund will be credited using the same payment method used to pay for your order.
I paid with a gift card and my credit card. How will I be refunded? In the case of mixed payment with a gift card, the portion paid by gift card will be refunded to the gift card in the event of a return. The remaining amount will be credited to your credit card accordingly.
CANCELLATION CLAUSE
Any total or partial non-performance by the customer of any of their obligations, as well as the non-observance of any payment deadline, may result, at the discretion of Glowing Skin or the Partner, either in the immediate payment of sums still due for any reason whatsoever, and the suspension of any delivery, or in the termination of ongoing contracts.
APPLICABLE LAW / DISPUTES
These General Terms and Conditions are subject to Swiss law. Any dispute related to these General Terms and Conditions falls under the exclusive jurisdiction of the ordinary courts of Geneva, Switzerland.

GENERAL TERMS OF USE FOR CUSTOMER REVIEWS
These Terms of Use govern the customer's conduct in connection with the customer review service.
By submitting your reviews or any other message to the Site, you warrant that:
- you are the sole author and owner of the intellectual property rights in the content;
- you have voluntarily waived all "moral rights" you may have in said content;
- all content you post is accurate;
- the use of the content you provide does not violate these terms of use and does not prejudice any person or entity.
- you assume full responsibility for the content of your contribution, to the complete discharge of Glowing Skin and/or the Partners
- Furthermore, you agree not to submit any content:
- that you know to be false, inaccurate or misleading;
- that infringes any copyright, patent, trademark, trade secret or other proprietary rights, publicity rights or privacy rights of any third party;
- that violates any law or ordinance, or any decree or regulation (including, but not limited to, those governing consumer protection, unfair competition, discrimination or false advertising);
- that is or may reasonably be considered defamatory, inciting hatred or racially or religiously insulting, unlawfully threatening or constituting unlawful harassment against any individual or business;
- for which you have been paid or received compensation by any unauthorized third party;
- that includes information referring to other websites, addresses, email addresses, contact details or phone numbers;
- that contains viruses or other potentially harmful computer programs or files.
You agree to indemnify and hold Glowing Skin and the Partners (as well as their officers, directors, agents, subsidiaries, joint ventures, employees and third-party service providers) harmless from all claims, demands and damages (direct and indirect) of every kind and nature, including reasonable attorneys' fees, that Glowing Skin and/or the Partners may suffer as a result of a breach of your above commitments and warranties, or your violation of any law or the rights of a third party.
All content you submit may be used at the sole discretion of Glowing Skin. Glowing Skin reserves the right to modify, condense, refuse publication, remove or delete any content on the Glowing Skin website that Glowing Skin deems, in its sole discretion, to be in violation of the content guidelines or any other clause of these Terms of Use. Glowing Skin does not guarantee the right to modify or delete any content you have submitted. Ratings and written comments are generally published within two to four business days, subject to the foregoing. No part of the content you submit will be subject to any confidentiality obligation on the part of Glowing Skin or the Partners.
